If you cannot perform the effect for actual people, or it is just an effect that looks good on YouTube, we will decline your submission. The MagicWeb is trying to elevate the art of magic and we can't do it alone. • The effect you submit must be creative - taking an old or established plot, or a marketed effect and changing patter does not make it worthy for the MagicWeb. The effect must be original. While the plot may be a classic or already established, some form of creativity and new idea must be present in the effect. The effect must also not violate any laws, regulations, statutes, or discriminate in any way. Your submission must also not be threatening or harassing in any way and cannot be obscene or adult in nature as MagicWeb is viewable by magicians of all ages, including minors. Users submitting any files or programs containing viruses or any malicious code will banned permanently and reported to the authorities. • Production quality - make sure you take pride in the work you accomplish, using a webcam to film your effect is ok but if we can't learn the effect because of lack of production quality or if the effect is also hindered, we will decline your submission. Your submission should not be too long, or too short. It should flow naturally and not have breaks. We will not select any material we deem to be too long or too short. • Submitted effects must be original - do your research! Your effect must be your own independent creation and a product of your own mind and creativity. Unless you have explicit permission from the original creator or have used ideas in public domain, the effect must be your own original idea. We will require crediting for any moves or sleights taught on the video. • Information for buyers: Once an order is submitted, it is not cancelable. Returns are not allowed for any reason unless the download is proven to be defective. By purchasing from MagicWeb, you agree that ownership of the video download remains with the producer and you agree not to distribute copies of your download for any reason. By paying for the download, you are acquiring a single copy of the video with a non-exclusive license for your personal viewing on your personal computer. Buyers also agree that MagicWeb is not responsible for inaccurate prices or information and that MagicWeb reserves the right to cancel or reverse any order. If an overpayment is discovered, MagicWeb will take the appropriate steps to refund such payments. • Information for sellers: Sellers have the ability to suggest a price for their submission(s); however MagicWeb will set the final price based on the quality, originality, etc. of the submission. Sellers are responsible for paying all fees and/or taxes on income generated by the site in accordance to local and federal laws. • By submitting any media for sale, you agree that you own the intellectual property in the content of said media, that it does not infringe any copyright or other intellectual property right of any other person or entity, that is does not violate any local, city, state, federal or any other law, ordinance, or statute, that the description you provide is not incorrect, inaccurate, or misleading in any way, or that the media and its content are not fraudulent, copied, stolen, or illegal in any way. If your submission is determined to be in violation of any laws or these Terms ofService, your account may be disabled and any earning associated with your account will be held until a resolution to the satisfaction of MagicWeb is reached. You also agree that in no way shall the submission create a liability for MagicWeb or its affiliates in any manner. • You agree that MagicWeb is under no obligation to you to publish or sell your submission. MagicWeb reserves the right to refuse any submission in its sole discretion and without providing any reason for the refusal. Furthermore, MagicWeb is not responsible for any and all losses that you may occur from the submission not being published. MagicWeb is not liable for any loss suffered by a Seller as a result of a Buyer making use of a product contrary to the conditions on which it was sold. As a seller on MagicWeb, you agree that we may use your submission at any time to promote the site in any matter or medium. • Sellers shall be entitled to seventy (70) percent of net revenue, not including any applicable taxes or fees. Sellers shall not be paid for any discounts offered by MagicWeb to buyers. The remaining thirty (30) percent of net revenue will retained by MagicWeb for services provided. Statements shall be provided to sellers once per month (if sales are made) detailing the prior month’s activity. Payment shall also be made once per month within a reasonable timeframe after the statement has been sent. All payments will be made in US Dollars. Prior to having any media uploaded to the site, Sellers must submit the appropriate tax forms – typically a W9 for sellers based in the United States and a W8 for foreign sellers. • You agree that MagicWeb cannot and does not guarantee any confidentiality respecting the content you submitted. By using MagicWeb, you agree that you are granting each user who downloads your content a non-exclusive license to access your content. This license is unending and irrevocable. • Any material submitted that is found to promote, sell, solicit, or in any other way seek funds shall be automatically rejected. This includes any commercial purpose for anything outside of MagicWeb. Users found doing so may be deleted and banned from the site. • You agree not to harass, intimidate, or contact MagicWeb or its users with any unsolicited messages. You also agree not to use any sort of automated system to access the site or send messages to other users. You agree not to use any means to artificially increase or decrease the ranking, statistics, comments, etc. of any content or user account, including your own. Any users found in violation may have their accounts cancelled in MagicWeb’s sole discretion and be banned from MagicWeb in MagicWeb’s sole discretion. • You will retain ownership of your content. By submitting content to MagicWeb your agree to grant us a non-exclusive, worldwide, royalty free license to use, display, and distribute submitted material as MagicWeb and its affiliates sees fit. By granting MagicWeb this license, you agree that we may continue to show your video after royalties paid to you have ceased and any comments or questions about the video remain property of MagicWeb. These Terms of Service and any rights or licenses granted here cannot be transferred or assigned to anyone by the user, however they may be assigned by Magic Place without limitations. • You agree not to download or distribute any material from MagicWeb without authorization. Material shall include all media associated with the site and any affiliated or third party sites. • Users agree that MagicWeb is not responsible for the accuracy, usefulness, safety, or intellectual property rights of any content. You also agree that MagicWeb is not responsible if any content is inaccurate, offensive, or objectionable to them. Any and all legal rights against MagicWeb shall be waived as permitted by law. • Content of MagicWeb shall only be accessed by users as instructed. You agree not to bypass, interfere, or attempt to disable MagicWeb’s security features.
